For any suspension greater than five days, called a “Superintendent’s Suspension,” the Department of Education must hold a school suspension hearing.

You will receive a notice in the mail that contains three important pieces of information:

  • The date and location of the hearing,
  • The charges against the student,
  • The location of the school where the student should be attending until the suspension decision.

It is very important to go to the alternate school site. A parent can request to have all of the student’s schoolwork sent to the alternate school.

Students can bring an attorney with them to the hearing. Having an attorney will help you decide whether to go forward with the hearing or to plead no contest to the charges. If you were arrested at school and were suspended from school, call Youth Represent.

Re-enrollment After Detention
In most cases, you have a right to return to the last school you were enrolled in before you were arrested. You also should receive some credit for any schooling you completed while in detention or incarcerated.

Superintendent suspensions from public schools increased by over 75% between 2000 and 2005.
